In principle, every student up to the age of 25 is entitled to child benefit if their annual income does not exceed a certain amount. BAföG recipients must note that half of the BAföG is counted as income. Anyone who has completed basic military service or community service can have their time counted additionally in order to maintain their entitlement to child benefit.
What about child benefit during a trainee job or during an internship after studying?
Even those who initially do a trainee job after completing their studies are entitled to child benefit, the Münster Finance Court ruled. In contrast to the family fund, the Münster judges recognized a temporary marketing job that was paid 7,800 euros annually as training time.
The Munich Finance Court made a similar decision in the case of a mechanical engineer who added a semester of business administration after receiving his diploma in order to find a job more quickly. In both cases, the Federal Finance Court must now decide. Until then, affected parents whose application for child benefit was rejected should file an objection (ref. III R 88/08 and ref. III R 80/08).
